Overview of the new technical reglament of the eurasian economic union on safety of chemical products

Abstract
This article provides a brief legal overview of the new Eurasian economic union (eaeu) technical reglament on safety of chemical products adopted on 4 march 2017. The new rules set out the unified eaeu mandatory safety requirements for chemical products placed on the market and provide a number of compliance procedures inspired by the eu reach/clp regimes. Although the entrance of the regulation into force is envisaged on 2 june 2021, it is conditional upon the adoption of extensive secondary legislation, which might be a challenging task.
INTRODUCTION
The below article provides a brief overview of the Technical Reglament of the Eurasian Economic Union TR 041/2017 “On Safety of Chemical Products” (‘TR EAEU 041/2017’ or ‘Reglament’) adopted on 3 March 2017. Upon entry into force in 2021, this legal act will be the cornerstone of chemical product regulation in the Eurasian Economic Union (‘EAEU’) and its member states (Russia, Kazakhstan, Belarus, Armenia and the Kyrgyz Republic).
Although inspired by the EU REACH and CLP regimes, the Reglament is much simpler and incorporates only limited concepts from those rules. The absence of most of the implementing secondary legislation also makes a direct comparison with the EU REACH/CLP regimes pointless at this stage.
TR EAEU 041/2017 establishes unified mandatory safety requirements for placing of chemical products on the market (supply and importation), and provides common rules on conformity assessment, identification, classification, naming and labelling of chemicals within the customs territory of the EAEU.
