Abstract

Following the departure of the UK from the EU, the implementation period finished on 31 December 2020. Therefore, new UK legislation entered into force on 1 January 2021. 

With full knowledge of the facts, the authorities have transposed EC regulation n ° 1223/2009 into local regulations. British requirements are therefore almost identical to what we know in Europe with regard to cosmetic products and also REACH.


INTRODUCTION

With the transition period ending on 31 December 2020, manufacturers must now take stock of their obligations regarding cosmetic finished products and their ingredients. 

 

Cosmetic regulations

On 14 October 2020, the British government validated the cosmetics regulation (UK Cosmetics Regulation (UKCR)). This is a transposition of EC regulation n ° 1223/2009 with specificities related to the British market such as labelling and product information file in English, the notification on a dedicated portal, etc.

This regulation came into force on 1 January 2021. All products exported to United Kingdom (UK) therefore have to comply. Note that transitional periods are planned on certain points to ensure continuity in market access.

On the other hand, this is not the case for Europe which imposes compliance from 1 January 2021. This impacts notably the products or substances previously held by British Responsible Persons (RP) who would like to continue to put cosmetic products on the European market.
